1. Tool — no guarantees

SyncPulse is a professional metronome tool for musicians. It is provided as-is, without warranty of any kind, express or implied. The developer does not guarantee uninterrupted, error-free, or timely operation.

You acknowledge that:

  • The app runs on Android, which may pause, restart, or stop any app due to battery management, OS behaviour, or hardware events.
  • Network connectivity, Bluetooth availability, and audio hardware can affect reliability.
  • SyncPulse is a tool, not a substitute for professional audio infrastructure (mixing consoles, dedicated click-track hardware, etc.).
Always have a backup plan for critical performances.

2. Limitation of liability

To the maximum extent permitted by applicable law, the developer shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to lost revenue, lost profits, cost of replacement services, or any damages arising from a failure of the app during a performance or rehearsal.

Where applicable, total liability is limited to the amount you paid for the app or the specific in-app purchase that directly caused the damage.

3. In-app purchases

SyncPulse may offer optional paid features in the future. Payments are processed by Google Play. The developer is not responsible for issues arising from Google's payment infrastructure. Refunds are subject to Google Play's refund policy.

4. Intellectual property

The app, its code, design, and content are the property of the developer, except where third-party open-source licences apply (see Credits & Open Source Licenses).

5. Governing law

These terms are governed by Dutch law. Any disputes shall be submitted exclusively to the competent court in Amsterdam, the Netherlands.

EU consumers may additionally rely on the mandatory consumer law protections of their country of residence.

6. Changes

If these terms change in future versions, the updated terms will be included in the app release and the "Last updated" date above will be updated. Continued use after an update constitutes acceptance of the revised terms.

1. Hulpmiddel — geen garanties

SyncPulse is een professioneel metronoom-hulpmiddel voor muzikanten. De app wordt aangeboden zoals hij is, zonder enige garantie, expliciet of impliciet. De ontwikkelaar garandeert niet dat de app zonder onderbrekingen, fouten of vertragingen zal functioneren.

Je erkent dat:

  • De app draait op Android, dat elke app kan pauzeren, herstarten of afsluiten wegens batterijbeheer, OS-gedrag of hardware-gebeurtenissen.
  • Netwerkverbinding, Bluetooth-beschikbaarheid en audiohardware de betrouwbaarheid kunnen beïnvloeden.
  • SyncPulse een hulpmiddel is, geen vervanging voor professionele audio-infrastructuur (mengpanelen, dedicated click-track-hardware, enz.).
Zorg altijd voor een back-up plan bij kritieke optredens.

2. Aansprakelijkheidsbeperking

Voor zover toegestaan door het toepasselijk recht is de ontwikkelaar niet aansprakelijk voor indirecte, incidentele of gevolgschade, waaronder gederfde inkomsten, winstderving, kosten van vervangende diensten, of schade die voortvloeit uit het wegvallen van de app tijdens een optreden of repetitie.

Waar van toepassing is de totale aansprakelijkheid beperkt tot het bedrag dat je hebt betaald voor de app of de specifieke in-app aankoop die de schade rechtstreeks heeft veroorzaakt.

3. In-app aankopen

SyncPulse kan in de toekomst optionele betaalde functies aanbieden. Betalingen verlopen via Google Play. De ontwikkelaar is niet verantwoordelijk voor problemen die voortvloeien uit Google's betaalinfrastructuur. Terugbetalingen vallen onder het retourbeleid van Google Play.

4. Intellectueel eigendom

De app, code, ontwerp en inhoud zijn eigendom van de ontwikkelaar, tenzij licenties van derden van toepassing zijn (zie Credits & Open Source-licenties).

5. Toepasselijk recht

Op deze voorwaarden is Nederlands recht van toepassing. Geschillen worden uitsluitend voorgelegd aan de bevoegde rechter te Amsterdam.

EU-consumenten kunnen daarnaast aanspraak maken op de dwingende consumentenbeschermingsregels van hun eigen verblijfland.

6. Wijzigingen

Als deze voorwaarden in toekomstige versies wijzigen, worden de bijgewerkte voorwaarden meegeleverd met de app-release en wordt de datum "Laatste update" hierboven bijgewerkt. Voortgezet gebruik na een update geldt als aanvaarding van de gewijzigde voorwaarden.
